  2. DEED TO INTEREST IN WELL 
  3.  
  4. WHEREAS, Wilma W. Wellowner, WELL OWNER, is the owner of the
  5. following described real property: 
  6.

  8. (see exhibit 1) 
  9.  
  10. which is improved by a well; 
  11.  
  12. and, 
  13.  
  14. WHEREAS, 
  15.  
  16. Grace G. Grantee, GRANTEE is the owner of the following described
  17. real property: 
  18.  
  19. (see exhibit 2) 
  20.  
  21. and WELL OWNER desires to grant to GRANTEE an undivided half
  22. interest in the well, in consideration of the mutual covenants
  23. herein, IT IS AGREED: 
  24.  
  25. The WELL OWNER grants to GRANTEE an undivided half interest in the
  26. well located on its property at: 
  27.  
  28. southwest corner 
  29.  
  30. together with the equipment related to and necessary for the
  31. operation of the well and storage of water. 
  32.  
  33. This conveyance is made on the condition that the GRANTEE and
  34. GRANTEE's heirs and assigns pay one-half of all expenses which are
  35. necessarily incurred to maintain and use the well, and the
  36. accessories and equipment related to and necessary for the
  37. operation of the well and storage of water. 
  38.  
  39. In addition, GRANTEE and GRANTEE's heirs and assigns shall
  40. maintain any pipes and other necessary equipment required to move
  41. the water to the GRANTEE's property in good repair. 
  42.  
  43. By this conveyance OWNER does not guarantee any particular amount
  44. or quality of water.
